Stakeholder Update

Dear CoC Colleagues,

As you probably know, the FY2026 CoC NOFO litigation remains active. The court has not scheduled a hearing on the parties’ requests for summary judgment by 8/10/26. Summary judgment means the judge decides the case based on the written legal briefs rather than a trial. The judge could issue a ruling as early as this week without holding a hearing. Unless HUD withdraws the FY2026 NOFO or the court blocks all or part of it, CT BOS will continue moving forward with the FY2026 competition. Despite the 8/26/26 deadline for CoCs to submit their consolidated applications, HUD has still not released critical components (i.e., the FY2026 CoC application or detailed application instructions). This is the portion of the application that describes the work we are doing together as a system and is how HUD determines our score.

Congress is also working on a continuing resolution (CR), which is a temporary funding bill that keeps the federal government operating while lawmakers continue negotiating the full federal budget for federal fiscal year 2027. The House passed a CR to fund the federal government through 12/4/26. The Senate is expected to vote this week. Neither proposal includes provisions related to the FY2026 CoC NOFO awards. There may be additional opportunities later this year to pursue legislation protecting CoC renewals, if the NOFO does not proceed as scheduled.
