FY 2025 CoC Competition
As you probably know, HUD is currently prohibited by a preliminary injunction from proceeding with a FY 2025 CoC Competition. Last week, HUD filed an emergency motion asking the Court by March 2nd to dissolve that preliminary injunction, or issue a final decision on the CoC Competition litigation. HUD has indicated their intent, if the motion were granted, to proceed with a competition for grants expiring in quarters 3 and 4 (Q3 and Q4) of calendar year 2026.
Earlier today the court denied that motion. This means that HUD cannot resume the 2025 CoC competition as they had intended. It does not mean that they must non-competitively renew all grants effective immediately. Since HUD only asked to re-initiate the competition for grants expiring in Q3 and Q4, and they are prohibited, at least for now, from proceeding with a competition, it seems very likely that Q2 grants will be renewed non-competitively along with the Q1 grants, which Congress already ordered them to renew. In CT BOS, approximately 40% of our grants and 60% of our funding expire in Q1 and Q2.
As you probably also know, Congress already established and HUD must honor these deadlines:
- If HUD does not conclude the FY2025 CoC Competition and announce awards prior to April 1, 2026, HUD must non-competitively renew for 12 months grants that expire in quarter 2 of Calendar Year 2026 (i.e., April to June)
- If HUD does not conclude the FY2025 CoC Competition and announce awards prior to July 1, 2026, HUD must non-competitively renew for 12 months grants that expire in quarters 3 and 4 of Calendar Year 2026 (i.e., July to December)
We are still waiting to hear whether HUD will be allowed to proceed at some point with a competition for a portion of the grants, but with each passing day that the injunction remains in place, the chances of seeing all grants renewed without a 2025 competition increase.
